Shop NowThey stamped “unaccompanied minor” on his file and let him roam free for “humanitarian reasons.” Because Colombian migrant Davi Vidal was only 17 when he illegally crossed the Arizona border he was welcomed in with open arms. He lied to Border Patrol agents, telling them he was going to see his aunt in Wisconsin. They were surprised to learn that ICE wanted to deport him from New York, after he murdered his landlady in Queens. He spent all day smoking weed but couldn’t pay the rent.
An un-escorted minor
The sister of victim Zoraida Leo is outraged that an unaccompanied minor from Columbia was able to evade authorities until he committed the murder. Alleged law enforcement kept his immigration status quiet at his criminal hearing “until it was too late.”
Originally from Columbia, Davi Vidal, now 20, jumped the Arizona border in June of 2022. When he illegally crossed near San Luis, he was apprehended, processed and released.
It’s a whole lot easier for a violent teen gang member to be approved for parole and asylum if the minor comes across alone. It was widely advertised, at the time, that approval to remain in the U.S. was “standard practice for lone underage migrants.”
Alejandro Mayorkas provided the service for “humanitarian reasons.” They didn’t bother to check him for gang tattoos or affiliation with terrorists or anything. Just gave him a cell phone and a bus ticket.
Vidal does have an aunt living in the U.S. but she doesn’t live in Wisconsin, like he told Border Patrol. He actually has two aunts living on Long Island in New York. He had been staying with one of them. He was no longer a minor by the time he got kicked out of the upscale neighborhood.
“The aunt’s husband flipped out after the migrant was found smoking pot and he was booted from the home, Maria Leo claimed. That’s when he rented the Queens apartment.” His aunt promised to pay the rent but she didn’t.

Smoking weed rent-free
Vidal was rather pleased with himself that he managed to enter America as a minor. It was truly the land of milk and honey where everything gets handed to you free.
Despite the Aunt’s assurance to Zoraida Leo that the rent would be covered, when she found out Vidal hadn’t been doing his part to find work, she backed out of the deal. Knowing squatters have rights, Vidal continued living in the apartment rent-free, “spending his days lounging around smoking weed.”
The migrant minor grew up suddenly when the landlady eventually “had enough and told him he was getting kicked out.”
On December 7, 2023, Vidal “allegedly got into a rent dispute with his landlord, Zoraida Leo, 55, and attacked her, leaving her to die inside her building on 96th Street near Northern Boulevard in East Elmhurst.” That’s when Immigration and Customs Enforcement finally put a detainer out on him.
Vidal’s immigration status was never mentioned when Queens District Attorney Melinda Katz announced the murder indictment against him. Apparently, though not a minor, being a migrant still has privileges.
“This person should get the stiffest sentence under the law,” Maria Leo insists. “After he serves his time here, he should be immediately deported so that he can never do harm to anyone here again.” A lot is going to depend on who comes out on top once all the election ballots are counted.
