President Donald Trump’s Department of Homeland Security (DHS) has declared that it will be enforcing a 1996 law that allows the department to fine illegal aliens $998 for every day that they stay in the U.S. past the date of their removal order.
They have also taken it one step further — announcing that the Trump administration will be enforcing these fines retroactively to cover up to five years-worth of fines, which could result in illegal aliens having fines of over $1 million.
Even further, the Trump administration is considering seizing the assets of illegal aliens who cannot afford the fines and refuse to self-deport.
In a statement, DHS spokesperson Tricia McLaughlin explained how illegal aliens can use the U.S. Customs and Border Protection (CBP) “Home App” to inform the federal government of their plans to leave the country. This app was previously known as the CBP One App, which the Biden administration used to allow illegal aliens to apply to enter the country — streamlining the flow of illegal immigration. However, almost immediately upon taking office, Trump overhauled that app, changing it to allow illegals to report their self-deportation efforts.
“If they don’t, they will face the consequences,” McLaughlin explained. “This includes a fine of $998 per day for every day that the illegal alien overstayed their final deportation order.”
These fines could affect approximately 1.4 million illegal aliens who are currently residing in the U.S. despite having active removal orders.

Currently, the Trump administration is advocating for CBP to administer the fines and seize illegal aliens’ property when warranted, though they are also considering giving these tasks to the Department of Justice’s (DOJ) civil asset forfeitures division.
Meanwhile, Democrats are already whining about the news, with former Biden administration U.S. Immigration and Customs Enforcement (ICE) policy official Scott Shuchart complaining that the fines will “project fear” among illegal aliens. He also noted that illegal aliens will be able to challenge the fines in court.
This news comes after Trump’s massive victories in the U.S. Supreme Court that have allowed him to continue deporting illegal alien gang members under the Alien Enemies Act of 1798.
