Special Counsel Jack Smith and his prosecutors made a big mistake in handling the evidence against Trump and it is going to cost him.
Prosecutors recently made a filing that they have been less than honest with the classified documents evidence.
On Tuesday, Judge Aileen Cannon had enough, postponing the case indefinitely.
Messing Around
Fox News legal analyst Gregg Jarrett tried to explain what happened here.
He stated, “Prosecutors have a duty to preserve evidence, Larry, exactly as it is seized.
“Jack Smith’s special counsel admits now in court documents altering, manipulating evidence against Trump.
“The digital scan of documents doesn’t match the physical order in the boxes that were seized.
“And Smith got caught. His excuse, ‘well, your honor it is a complicated case, lots of documents,’ that is not an excuse.
“This is evidence tampering. It is destroying exculpatory evidence and even worse, Smith lied to the court and he was forced to admit it although he did so in a footnote, ‘gee, I misled the judge.’ This is no small matter, Larry.”
Jarrett turned out to be prophetic, as Judge Cannon announced later on Tuesday that the trial was going to be postponed with no trial date set.
Cannon noted that there are just way too many issues to be settled right now regarding the classified documents that there is no way this case will be ready to go by the original scheduled trial date (which was later this month).
With that delay, my guess is that this case never sees the inside of a courtroom before election day, which is a dream come true for Trump.
Now both of the worst cases against Trump have been delayed, and the Georgia case is also still up in the air.
All Trump needs to do is beat the Bragg case either in the courtroom or an appeal, and it would appear that he would be in the clear.
