The U.S. Court of Appeals for Washington, D.C., has ruled against former President Donald Trump in his attempt to block documents that he argues fall under executive privilege from the House January 6th committee.
The three-judge panel of the appeals court — which is composed of Judges Millet, Robert L. Wilkins, and Ketanji Brown Jackson, all appointed by either Joe Biden or former President Barack Obama — upheld a lower court’s opinion, which claimed that “when there is a dispute between a current and former president over whether to release records from the White House, the standing president’s assertion prevails,” according to reporting by the Washington Examiner.
“On the record before us, former President Trump has provided no basis for this court to override President Biden’s judgment and the agreement and accommodations worked out between the Political Branches over these documents,” Circuit Judge Patricia Millett wrote in the 3-0 opinion.
The court’s ruling will be paused for two weeks to give Trump time to seek intervention from the Supreme Court, which will be his last resort.
Trump’s attorneys argued last month that a “handful of documents” needed to be withheld from the January 6th committee because of executive privilege. Biden is obviously rejecting Trump’s claims.
Attorneys for the House of Representatives are claiming that the committee needs the records “to complete a thorough investigation into how the actions of the former president, his advisers, and other government officials may have contributed to the attack on Congress to impede the peaceful transfer of presidential power.”
Of course, they have absolutely no proof that Trump or any members of his administration had anything to do with the Capitol riot. Trump himself was still speaking at his rally when the initial break-in took place. A large crowd of his supporters were still there to hear him speak, far away from the Capitol. While he was speaking, there was no way for him to be made aware of what was happening. But the Democrats and the RINOs on the January 6th Committee don’t care about those facts. The committee’s goal is a partisan witch-hunt, and they want to get as many documents as they can to get as much information as they can. The Russia Collusion Hoax failed, the Ukrainian “Quid Pro Quo” Hoax failed, and their attempts to slander Trump with his tax returns failed. They are hoping January 6th will be their golden ticket to getting rid of Donald Trump for good.
