Shop NowA New York City jury cleared Daniel Penny in the death of Jordan Neely. The 26-year-old subway vigilante was formally “acquitted of homicide for putting an unarmed homeless man in a fatal chokehold.” Mentally unstable Mr. Neely was running amok and a danger to everyone on the subway. It seems that the jury wasn’t real happy with the bait and switch scheme the prosecutor and judge threw at them at the last moment.
Penny cleared on all charges
After deliberating for a grueling five days, the jury declared Daniel Penny “not guilty beyond a reasonable doubt.” They deadlocked over a more serious charge of second-degree manslaughter.
Instead of declaring a mistrial, the judge agreed with prosecutors and allowed them to substitute a lesser allegation of criminally negligent homicide.
After kicking it around some more, the jurors who had been holding out for murder charges changed their minds, deciding that Penny only did what he felt he had to do because there wasn’t any other choice.
Maybe he could have done things a little differently and it’s unfortunate that Mr. Neely died in the encounter but New York City subways have become a very dangerous place. Thanks to liberal Democrat prosecutors like Alvin Bragg, who trump up charges when they’re politically motivated, yet turn mentally ill individuals who commit crimes right back on the street to commit more crimes.
When the verdict came in, the announcement was “met with loud applause in the Manhattan court.” The furious judge kept pounding his gavel but nobody could hear it.
Penny, “who served four years in the Marines before studying architecture,” appeared “to smile while his attorneys hugged.” He wasn’t happy about the death of the 30-year-old Michael Jackson impersonator but thrilled he wasn’t going to prison over it.

Stand up for one another
Shortly after the favorable verdict was handed down, the defense team issued a formal statement. “We couldn’t be more pleased that a jury of Danny’s peers acquitted him of any wrongdoing.”
Penny used his military training to do the job police should have been doing. “New Yorkers can take some comfort in knowing that we can continue to stand up for one another without sacrificing our rights or our freedoms.”
One person inside the courtroom was definitely not applauding. “Mr. Neely’s father, Andre Zachery, was removed from court for shouting after the verdict.” Meanwhile as social justice protesters gathered outside the building got word of the decision, chants of “no justice, no peace” could be heard echoing down the block.
Outside, Zachery stopped to chat with reporters. “It hurts. It really, really hurts. What’s gonna happen to us now? I’ve had enough of this.” He doesn’t feel that Penny was doing the community any great service.
Progressive Democrats believe that prosecuting criminals who are of minority ethnicity is “racist.” Liberal prosecutors routinely allow violent criminals right back out with less than a slap on the wrist. Drug addicts are allowed to sleep on the streets, panhandle and steal.
Seriously mentally ill individuals were once segregated away from the general population in places where they could get help tailored to their needs. That’s also offensive to liberals. Instead they prefer allowing them to roam around freely and self-medicate with whatever comes to hand. The last thing they want to see is citizens like Daniel Penny taking the law into their own hands.
One of those liberal progressives is New York congresswoman Alexandria Ocasio-Cortez. The rabidly left-wing Democrat ranted on social media at the time of his death that “Jordan Neely was murdered.” She doesn’t care that he put the lives of several innocent subway riders at risk with his psychotic behavior.
“He was houseless and crying for food in a time when the city is raising rents and stripping services.” He was also violent and terrorizing subway passengers. “One woman on the train said that Mr Neely made lunging movements that scared her enough to shield her young child from him.” That’s about when Mr. Penny stepped in to do the city’s job for them.
