Democrats in Arizona are celebrating what appears on the surface to be a big win for them.
However, this could actually help the GOP far more this close to the election.
This all revolves around the recent Arizona Supreme Court stay that was issued on the 1864 abortion law.
The Reversal
So, the court issues a 90-day stay to block the law from going into effect.
The stay was requested by and granted to Democrat AZ Attorney General Kris Mayes.
Due to other legal issues pending, the law is now blocked from taking effect until at least September, possibly longer if more legal challenges arise.
Mayes took a victory lap, stating, “I continue to believe this case was wrongly decided, and there are issues that merit additional judicial review.
“I will do everything I can to ensure that doctors can provide medical care for their patients according to their best judgment, not the beliefs of the men elected to the territorial legislature 160 years ago.”
Here is the thing, though.
We have all seen how abortion has impacted elections in the past, really hurting the GOP.
Arizona Democrats want to use this law against Republicans in the upcoming cycle and quite frankly, this law has already impacted the race, by flipping the standings in the AZ Senate race to now favor Democrats.
If this law is stayed, perhaps it will be on the backburner of voters and allow the GOP to win big in a state that it used to dominate but now struggles to put Republicans in office.
If the abortion ban is overturned, then the previous law that was signed by Doug Ducey would be in play.
That law places a ban on abortion after 15 weeks.
