The incident occurred in August 2021 when Smith’s daughter was sexually assaulted by a biological male wearing a skirt in the restroom at Stone Bridge High School. Outraged by the lack of action taken by school officials, Smith confronted board members and was later charged with disorderly conduct.
Governor Youngkin made the announcement on Fox News Sunday, saying he had signed the pardon on Friday. He explained that Smith did what any parent would have done—stand up for their child—and that prosecuting him was an egregious miscarriage of justice.

Youngkin also commented on current efforts to ensure Virginia public schools are meeting requirements to inform parents if their child expresses gender confusion at school. He also addressed rumors suggesting he may join the Republican presidential primary race though no commitments were made.
“I spoke with Mr. Smith on Friday, and I had the privilege of telling Mr. Smith that I will pardon him, and we did that on Friday,” Youngkin said. “We righted a wrong. He should’ve never been prosecuted here. This was a dad standing up for his daughter.”

“Mr. Smith did what any father would do, what any parent would do, which is stand up for their child,” Youngkin said. “This was a gross miscarriage of justice.”
