Shop NowThe recent ruling by Philadelphia County Court of Common Pleas Judge Michael Erdos that claims made by former President Donald Trump about the outcome of the 2020 election are protected under presidential immunity is a victory for Republicans everywhere.
The decision shows that even in an election fraught with controversy and accusations, the constitutional rights of our leaders must be respected.
Judge Michael Erdos ruled that a state election worker could not sue Trump despite statements he made casting doubts about the outcome of the election in Pennsylvania which went to Joe Biden in 2020.
According to The Hill, “Erdos said Trump’s immunity covered a tweet he issued and comments he made remotely from the White House during a Pennsylvania state Senate committee hearing in November 2020. The statements, made without evidence, claimed fraud in Pennsylvania’s election tabulations.”
In his ruling, Erdos noted: “Other legal proceedings may examine the propriety of his statements and actions while he was the President…But this case is not the proper place to do so. Here, Trump is entitled to Presidential immunity.”
James Savage had filed two consolidated lawsuits against Donald Trump, Rudy Giuliani, two poll watchers and others claiming they conspired to defame him resulting in death threats directed at him causing him to suffer two heart attacks according to The Hill reportage.
However, as per Erdos’ ruling Trump has immunity for his tweet and remarks made at the state Senate hearing since they were part of his official duties when serving as president but isn’t immune from claims over a letter written after leaving office since it was written after he left office.
Trump’s daughter-in-law Lara defended her father-in-law’s efforts during an interview following being charged with four felony counts related to allegations that he fraudulently attempted overturning his loss saying, “Quite frankly, I don’t think we’ve ever had an election in United States history where we’ve come out having more questions than we did post-2020”.
She further added that she repeatedly received reports detailing “very questionable, nefarious things” seen at different polling locations while working as senior adviser for 2020 campaign.
