Jackson hammered an attorney representing a group of students pushing back on school affirmative action admissions.
We warned about this during the nomination process, and now our worst fears have come true.
No Race Qualifier
The argument being made is that in this day and age, race should not come into play.
Jackson is trying to disqualify the case by stating that there were no examples when race was the only factor, which is ridiculous.
Race is a major factor, just not the ONLY factor. However, it is often the one that catapults one applicant over the other.
Jackson was drilling Students for Fair Admissions (SFFA) lawyer Patrick Strawbridge.
She asked, “Why is it that race is doing anything different to your members’ ability to compete in this environment?
“It’s in the context of all of the other factors…the admissions office is looking at.
“You haven’t demonstrated or shown one situation in which all they look at is race. They’re looking at the full person.”
Strawbridge responded, “It makes no sense in a zero-sum game.
“If we are going to consider race, and we argue that a racial classification – which is highly disfavored at law because of its necessarily invidious nature – is going to be used, it clearly must be doing some work.”
The court currently has two cases before it on this, one from North Carolina and one from Harvard.
I think it is safe to say that we know where Jackson stands.
