In a dramatic 4-3 decision the Wisconsin Supreme Court struck down Democrat Governor Tony Evers’ statewide mask mandate. The Court dealt a harsh defeat to Gov. Evers ruling that he exceeded his executive powers as Governor. Local jurisdictions in Wisconsin still have the option to enact their own COVID19 mask mandates. This decision comes as Arkansas, Arizona, Iowa, Mississippi, Montana, Texas and Wyoming have dropped their mask mandates brining the total number of states with no-mandate or a local-only mandates to 19. As Fauci, Birx and Biden-Harris lose credibility, more and more states are waking up.
According to WCCO CBS Minnesota, Gov. Evers ran afoul of the Wisconsin Constitution when he attempted to buck a legislative repeal of the mask mandate, by reinstating it through Executive order.
“The GOP-controlled legislature passed a law repealing the mask mandate and Gov. Evers quickly re-issued it. A major Republican donor sued, and the conservative-leaning Supreme Court ruled that Evers unlawfully overstepped his authority in requiring masks.”
Justice Brian Hagedorn wrote for the conservative majority,
“The governor’s power to act unilaterally on an emergency basis is limited by both a 60-day limit and by the legislature’s power to terminate the emergency declaration.”
“The question in this case is not whether the governor acted wisely; it is whether he acted lawfully. We conclude he did not,”
Republicans Respond to WI Supreme Court Decision
Republican legislators were seemingly pleased with the decision, Assembly Speaker Robin Vos told the press, according to Fox6
“I think many of us have supported that people have the right to wear masks. Businesses have the right to require it. But we are far beyond the time when it’s the job of the government to tell people whether or not a mask is appropriate, It should be the private sector. It should be the private business owner.”
Senate Majority Leader Devin LeMahieu said in a statement,
“I applaud the Court for ending this constitutional crisis in our state. Their ruling upholds the separation of powers and the rule of law – core principles since the founding of our state and nation. The Governor’s repeated abuse of emergency powers and pervasive violation of state statute created a state of chaos and had to be stopped. The Legislature exercised its authority to revoke Governor Evers’ order in February, and today the Court handed down the final rebuke of the Governor’s illegal actions.
“Today’s ruling vindicates the Legislature as a co-equal branch of government and will expand freedom and opportunity for the people of Wisconsin. As we work to fully and safely reopen our state, we trust our residents to follow CDC guidelines when appropriate, get vaccinated when ready, and always employ common sense.”

This is yet another legal defeat for the attempted despot in Madison, WI. The State Supreme Court struck down his stay-at-home order in May, and the Appeals court blocked his attempts to limit bar, restaurant and business capacities in October.
Of his failed executive mask mandate Gov. Evers said Wednesday, “At the state level, it is gone. I respect the decision of the supreme court, even though I think it was erroneous on a legal issue and frankly a moral issue,” The Supreme Court of Wisconsin, your legislature and a growing number of other States would disagree Governor. We don’t like tyrants who try to roll their legislature.
